1. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site.

The name “Alva Japan Tours,” our logos, brand elements, and related marks may not be used without our prior written permission.

3. Tour Bookings, Payments, and Third-Party Payment Services

a. Bookings

Bookings for tours and experiences offered by Alva Japan Tours may be made directly through our Site. A booking is not confirmed until the applicable payment has been successfully completed and a booking confirmation has been issued by us.

Tour details, including the meeting point, start time, duration, itinerary, included items, excluded items, language, age requirements, cancellation conditions, and other important information, are stated on each tour page. Please review all details carefully before making a booking.

b. Payments

Payments are processed through third-party payment service providers, such as Stripe, PayPal, Amazon Pay, or other payment methods made available at checkout.

By making a payment through our Site, you agree to comply with the applicable terms, conditions, and policies of the relevant payment service provider. We do not store full credit card information on our own servers unless expressly stated otherwise.

c. Payment Errors and Authorization

We are not responsible for payment failures, authorization declines, processing delays, security checks, or other issues caused by third-party payment service providers, card issuers, banks, mobile payment providers, or other financial institutions.

If a payment is not successfully completed, your booking may not be confirmed.

d. Pricing and Taxes

Tour prices are displayed on the relevant tour page. Prices may include or exclude taxes, service fees, booking fees, facility fees, or other charges as indicated at the time of booking.

The final amount payable will be shown before checkout. You are responsible for confirming the total amount before completing payment.

We reserve the right to correct any obvious pricing errors. If a booking is affected by a pricing error, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the booking.

e. Cancellation, Refunds, and Rescheduling

Cancellations, refunds, rescheduling, late arrivals, and no-show conditions are governed by our Cancellation and Refund Policy and any specific conditions stated on the relevant tour page.

In the event of any inconsistency between these Terms, the Cancellation and Refund Policy, and the conditions stated on a specific tour page, the specific conditions stated on the tour page shall prevail to the extent permitted by applicable law.

f. Right to Refuse or Cancel Bookings

We reserve the right to refuse or cancel any booking if we reasonably suspect fraud, unauthorized payment, misuse of the Site, violation of these Terms, violation of applicable laws, or any behavior that may affect the safety, comfort, or enjoyment of other participants, our guides, our staff, partner facilities, or third-party service providers.

If we cancel a booking for reasons attributable to us, we will provide an appropriate refund in accordance with our Cancellation and Refund Policy.

4. Tour Participation and Participant Responsibilities

By participating in a tour or experience, you agree to act responsibly and follow the instructions of our guides, staff, and any third-party facilities or service providers involved in the tour.

You are responsible for:

a. arriving at the meeting point on time;
b. checking the tour details, meeting point, start time, and required items before the tour;
c. managing your own health, physical condition, belongings, and valuables;
d. informing us in advance of any allergies, dietary restrictions, mobility limitations, medical conditions, or other special requirements that may affect your participation;
e. complying with local laws, facility rules, public transportation rules, and guide instructions;
f. behaving respectfully toward guides, staff, other participants, local residents, shops, restaurants, facilities, and the general public.

We may refuse participation or remove a participant from a tour without refund if the participant is late, intoxicated, disruptive, abusive, dangerous, violates these Terms, violates facility rules, or otherwise interferes with the safe and enjoyable operation of the tour.

5. Age Requirements, Alcohol, and Minors

Some tours or experiences may have age restrictions. For example, tours involving alcohol may require participants to be at least 20 years old, which is the legal drinking age in Japan.

Age requirements, child participation rules, and minor-related conditions will be stated on the relevant tour page where applicable.

Participants may be required to present valid identification to confirm their age. If a participant fails to meet the applicable age requirement, we may refuse participation without refund to the extent permitted by applicable law and the relevant tour conditions.

Minors must be accompanied by a parent, guardian, or responsible adult unless otherwise stated on the relevant tour page.

6. Allergies, Dietary Restrictions, and Special Requests

Some tours may include food, beverages, restaurants, markets, cooking experiences, tastings, or visits to third-party facilities.

If you have allergies, dietary restrictions, religious requirements, mobility limitations, medical conditions, or other special requests, you must inform us before booking or as early as possible before the tour.

We will make reasonable efforts to accommodate special requests where possible, but we cannot guarantee that all requests can be met. We are not responsible for any issues arising from information that was not provided to us in advance or from ingredients, preparation methods, cross-contamination, or services provided by third-party restaurants, shops, facilities, or vendors.

7. Changes to Tours

Tour routes, schedules, destinations, facilities, menus, transportation methods, and other details may be changed due to weather, traffic, public transportation delays, facility closures, operational reasons, safety concerns, local events, crowd conditions, or other circumstances beyond our reasonable control.

We will make reasonable efforts to provide an experience that is as close as possible to the description on the relevant tour page. However, certain changes may be necessary for safety, operational, or quality reasons.

Such changes do not automatically entitle participants to a refund unless otherwise stated in our Cancellation and Refund Policy or required by applicable law.

8. Third-Party Facilities and Services

Some tours may involve third-party facilities, restaurants, shops, transportation providers, cultural venues, instructors, performers, or other service providers.

While we carefully select and coordinate with third-party service providers, we do not own or control all such providers. Participants must comply with the rules, instructions, and policies of any third-party facility or service provider involved in the tour.

We are not responsible for acts, omissions, delays, closures, rule changes, service quality issues, or other matters attributable to third-party service providers, except to the extent such responsibility cannot be excluded under applicable law.

9. Disclaimer of Warranties and Limitation of Liability

a. Site Content

We make reasonable efforts to ensure that the information on our Site is accurate and up to date. However, tour details, schedules, routes, facilities, prices, availability, and other information may change from time to time.

The Site and its content are provided on an “as is” and “as available” basis. We do not guarantee that the Site will always be available, uninterrupted, secure, error-free, or free from viruses or other harmful components.

b. Tours and Services

Alva Japan Tours will provide tours and services with reasonable care and skill. However, participants acknowledge that tours may involve walking, public transportation, crowded areas, outdoor conditions, food and beverage experiences, cultural activities, or other inherent risks.

Participants are responsible for their own health, belongings, and personal conduct during the tour.

c. Limitation of Liability

To the extent permitted by applicable law, Alva Japan Tours shall not be liable for any loss, damage, injury, delay, expense, or inconvenience arising from reasons not attributable to us, including but not limited to weather, traffic, public transportation delays, facility closures, acts or omissions of third-party service providers, participant conduct, participant health conditions, lost or stolen belongings, or failure to follow guide instructions.

d. Mandatory Liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from our willful misconduct or gross negligence.

10. Links to Other Websites

Our Site may contain links to third-party websites, services, maps, social media pages, payment services, or other external resources that are not owned or controlled by Alva Japan Tours.

We are not responsible for the content, privacy policies, terms, practices, availability, accuracy, or security of any third-party websites or services.

Participants may take photos or videos during tours for personal use, unless prohibited by the guide, facility rules, local rules, or the privacy rights of others. Participants must not take or publish photos or videos that infringe the rights, privacy, or safety of other participants, guides, staff, local residents, facilities, or third parties.

14. Indemnification

You agree to indemnify, defend, and hold harmless Alva Japan Tours, AlvaJapan LLC, its officers, directors, employees, contractors, guides, agents, partners, and service providers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

a. your use or misuse of the Site;
b. your violation of these Terms;
c. your violation of applicable laws or regulations;
d. your violation of any rights of a third party;
e. your conduct during a tour or experience;
f. any false, inaccurate, or incomplete information provided by you.
